E Jean Carroll, a magazine feature writer and TV host, claimed in her 2019 memoir that she was raped by Donald Trump. The incident allegedly occurred in the upmarket New York department store Bergdorf Goodman, where Ms Carroll bumped into Mr Trump who recognised her as “that advice lady” while she knew him as “that real-estate tycoon.” According to Ms Carroll, Mr Trump asked for her help in choosing an item for a girl he was buying a gift for, before suggesting she try on a lace bodysuit in the lingerie section. As they reached the dressing rooms, she alleges that Mr Trump shoved her against a wall, pulled down her tights, and raped her after he had unzipped his pants. The former US President, who was married to Marla Maples at the time, has denied the allegations and called her a “complete con job.” Ms Carroll filed a defamation lawsuit against Mr Trump, and after the DoJ intervened, the case was transferred to a federal court. In 2022, New York passed the Adult Survivors Act, which allowed adult sexual assault survivors to sue their alleged abusers within one year. Consequently, Ms Carroll filed a second lawsuit against Mr Trump for rape and defamation, which began on 25 April. The central question in both cases is whether Mr Trump raped Ms Carroll. If he did, then Ms Carroll’s sexual assault and libel claims in both cases might succeed, hence the request to provide a DNA sample to compare with stains found on the dress she wore on the day. However, the former President’s attorneys refused to provide the sample despite his 11th-hour offer, which Judge Kaplan rejected. The trial is being heard in civil court, and Mr Trump’s legal team has indicated that they will not present any witnesses or a defence case.
